ZALaw Jury Trial Victory!


On October 7, 2016, ZALaw secured a jury verdict in favor of its client in a bad faith breach of insurance contract matter filed in the U.S. District Court for the State of Colorado.

ZALaw was hired to defend an insurance company against claims of bad faith and breach of contract regarding alleged hail damage to the roof of a motel in northeast Denver. The Plaintiff alleged that a hailstorm in 2013 damaged the roof of the motel which subsequently caused significant water intrusion into certain motel rooms. In addition to the cost to replace the roof, Plaintiff also sought alleged loss of income and related damages.

Through the course of litigation, the bad faith claims were withdrawn, leaving only the breach of contract claim to be decided at trial.  Through an exciting exchange of expert witness testimony, ZALaw partner Muliha Khan and associate Erica Payne were able to argue that not only was any damage to the interior of the building not attributable to hail, but also that there was not hailstorm at the motel in question on the date of loss.  After less than two hours of deliberation, the jury returned a defense verdict, giving ZALaw and its client the win!
